AN ACT TO AMEND SECTION 7, CHAPTER 499, LAWS OF 1998, TO EXTEND THE REPEALER ON THE AUTHORITY OF THE QUITMAN COUNTY SCHOOL DISTRICT TO TRANSFER THE OLD FALCON SCHOOL PROPERTY TO THE QUITMAN COUNTY BOARD OF SUPERVISORS FOR USE AS A SENIOR OR ELDERLY DAY CARE FACILITY; TO AUTHORIZE THE BOARD OF TRUSTEES OF TYLER HOLMES MEMORIAL HOSPITAL IN MONTGOMERY COUNTY, MISSISSIPPI, TO CONVEY CERTAIN REAL PROPERTY AND THE IMPROVEMENTS THEREON, WHICH THE BOARD OF TRUSTEES HAS BEEN DETERMINED TO BE SURPLUS PROPERTY OR OTHERWISE NOT NECESSARY IN THE OPERATIONS OF THE HOSPITAL, TO THE GOVERNING AUTHORITIES OF THE CITY OF WINONA, MISSISSIPPI; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 7, Chapter 499, Laws of 1998, is amended as follows:

Section 7. Supplementary to any other law, the Quitman County School District may transfer for nominal consideration or no consideration the Old Falcon School property to the Quitman County Board of Supervisors for use for a senior or elderly day care facility, provided that said transaction is made before January 1, 2000. This section shall * * * stand repealed on January 1, 2000.

SECTION 2. (1) Notwithstanding the provisions of any law to the contrary, the Board of Trustees of Tyler Holmes Memorial Hospital in Montgomery County, Mississippi, may convey any or all of the parcel of real property described in this section and the improvements thereon, which the board of trustees has determined to be surplus property or otherwise not necessary in the operations of the hospital, to the governing authorities of the City of Winona, Mississippi, the property being more particularly described as follows:

90 X 181.5 feet located East of the Courthouse Lot and West of the M.C. Billingsley Lot and being Lot 235 and part of Lot 234, Mercer West, Winona, Montgomery County, Mississippi, and situated in the NE 1/4 of Section 26, Township 19 North, Range 5 East, Winona, Montgomery County, Mississippi, more particularly described by metes and bounds as follows:

Beginning at an iron stake on the North boundary of Summit Street which marks the Southwest corner of said Lot 235 and the Southeast corner of Lot 236, Mercer West, Winona, Montgomery County, Mississippi, same being the Southwest corner of the Church Lot and the Southeast corner of the Courthouse Lot as a Point of Beginning, and running thence South 86 Degrees 30 Minutes East along the North boundary of Summit Street 90 feet to an iron stake on the North boundary of Summit Street at the Southwest corner of the M.C. Billingsley Lot; thence North along the M.C. Billingsley fence line 181.5 feet to an iron stake on said fence line; thence North 86 Degrees 30 Minutes West parallel with Summit Street 90 feet to an iron stake on the East fence line of the Courthouse Lot; thence South along the East line of said Courthouse Lot 181.5 feet to the Point of Beginning:

LESS AND EXCEPT: That certain easement reserved by Warren Sanders, same being 20 feet on the West side of said property.

(2) The conveyance authorized by this section may be made on such terms and conditions agreed upon by the Board of Trustees of Tyler Holmes Memorial Hospital and the governing authorities of the City of Winona, Mississippi, to be in the best interests of both parties as well as the citizens of the community.

(3) This section shall be deemed to be full and complete authority for the exercise of the powers herein granted and shall be considered additional, supplemental and alternative to any other authority granted by law.

SECTION 3. This act shall take effect and be in force from and after January 1, 1999.
